1320 – Suspension of the Policy
The policy of the Board shall be subject to suspension by a majority vote of the members present, provided all NWESD 189 Directors had received notice of the meeting and the provided notice included a proposal to suspend the specific policy with a rationale. If such proposal is not made in writing in advance of the meeting, the policy may be suspended only by a unanimous vote of all Board Directors present.
The Superintendent, or designee, shall be authorized to use best judgment in the absence of a specific policy or procedure, provided such action shall not be in conflict with the general aims and objectives of the NWESD 189 or with any local, state, or federal ordinances, statutes, regulations, or directives.
Whenever action in the absence of specific policy has been taken by the Superintendent, or designee, which creates a potential for controversy or a potential for the incurring of NWESD 189 financial obligation or where the situation is likely to reoccur frequently, then such action shall be brought to the attention of the Board at its next regular meeting. In situations where a reasonable person could determine the above actions taken should be brought to the immediate attention of the Board, the Superintendent shall immediately, or as soon as possible, consult with the Board president as to the advisability of calling a special Board meeting to review the action.
The Superintendent, or designee, shall be authorized to temporarily act contrary to Board policy provided, in his/her professional judgment, such action is appropriate 1) to protect the health or safety of students/staff, 2) to comply with county, state, or federal statutes, or 3) for other just cause. Whenever such action is deemed appropriate, it shall be brought to the attention of the Board at its next regular meeting. In situations where a reasonable person could determine the above actions taken should be brought to the immediate attention of the Board, the Superintendent shall immediately, or as soon as possible, consult with the Board president as to the advisability of calling a special Board meeting to review the action.
